The Republican Party needs to understand that it was bad enough when someone stabbed the autism community (and those who care about it) in the back with the secret thimerosal rider. We need to let them know that the Republican Party will be held accountable if they stab us in the heart by electing Frist as the majority leader.

OK, Here is the bill (S2053), that Bill Frist sponsored that contains the Eli Lily liability relief paragraphs Frist has had it ready to go for some time. It is my speculation that in was written in cohoots with Eli Lilly.
Frist was not successful in getting the bill nor was he successful in sneaking into any bill, i.e., until the Homeland Security Bill came along.
I have copied the three paragraphs Sections 214, 215, and 216 from the Frist's bill S2053, and for ease of comparison each section in the Frist bill is followed by the corresponding paragraph in the Homeland Security Bill sections 1714, 1715 and 1715. The wording section 1716 in the HS bill, the section that prohibits all Law suits, contains all the restrictions of section 213 of the Frist with simp1lied language.
Walla', you do not have to be a Sherlock to quickly realize the corresponding paragraphs are identical word for word. So after the congress(wo)man had completed reviewing the text of this bill over a period of a few weeks and had made their minds on their vote during the darkness the night before next morning's vote, this a small group of slimeballs, added 12 sections to the bill. Now Dick Armey was the bill's manager, he knew, the words came from the bill Frist had written, he knew, no change could/ would be made without the blessing our straight up Prez, and his men would you think, he/they knew, Eli Lily probably inputted heavily to Frist when it was first being written and followed up with a million and a half to the George Bush campaign and G*d only how much to the Republican Party.
So many people knew and the words have been around for some time.
Just one other thought: Section 1717 of the Homeland Security Bill gives retro active liability relief to Eli Lily. I'm sure the words are based on words in the Frist bill, I just didn't want to struggle any more. If you locate the words, please let me know.
So who do I think knew, at a minimum, Dick Armey, Trent Lot, Bill Frist, Eli Lily operatives, George Bush and his men.

(1) in the first sentence, by striking `under its label any vaccine set forth in the Vaccine Injury Table' and inserting `any vaccine set forth in
the Vaccine Injury table, including any component or ingredient of any such vaccine'; and
(2) in the second sentence, by inserting `including any component or ingredient of any such vaccine' before the period.

SEC. 214. CLARIFICATION OF STANDARDS OF RESPONSIBILITY.
(a) GENERAL RULE- Section 2122(a) of the Public Health Service Act (42 U.S.C. 300aa-22(a)) is amended by striking `and (e) State law shall apply to a civil action brought for damages' and inserting `(d), and (f) State law shall apply to a civil action brought for damages or equitable relief';
and
(b) UNAVOIDABLE ADVERSE SIDE EFFECTS- Section 2122(b)(1) of the Public Health Service Act (42 U.S.C. 300aa-22(b)(1)) is amended by inserting `or equitable relief' after `for damages'.
(c) DIRECT WARNINGS- Section 2122(c) of the Public Health Service Act (42 U.S.C. 300aa-22(c)) is amended by inserting `or equitable relief' after `for damages'.
(d) CONSTRUCTION- Section 2122(d) of the Public Health Service Act (42 U.S.C. 300aa-22(d)) is amended--
(1) by inserting `or equitable relief' after `for damages'; and
(2) by inserting `or relief' after `which damages'.
(e) PRESENT PHYSICAL INJURY- Section 2122 of the Public Health Service Act (42 U.S.C. 300aa-22) is amended--
(1) by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; and
(2) by inserting after subsection (c) the following:
`(d) PRESENT PHYSICAL INJURY- No vaccine manufacturer or vaccine administrator shall be liable in a civil action brought after October 1, 1988, for equitable or monetary relief absent proof of present physical injury from the administration of a vaccine, nor shall any vaccine manufacturer or vaccine administrator be liable in any such civil action for claims of medical monitoring, or increased risk of harm.'.

SEC. 1717. EFFECTIVE DATE.
The amendments made by sections 1714, 1715, and 1716 shall apply to all actions or proceedings pending on or after the date of enactment of this Act, unless a court of competent jurisdiction has entered judgment (regardless of whether the time for appeal has expired) in such action or proceeding disposing of the entire action or proceeding.
