The public has this erroneous idea that everything can be litigated. Someone looks at you the wrong way, doesn't want to be your friend, acts imorally, inflicts emotional pain, SUE 'EM.
But more often then not, there's just no case - or none worth pursuing.

One of the problems with litigation in this country is that people and companies sue each other knowing full well that they have no real basis to do so, but counting on the defendant to settle for some sum simply to avoid the agony and expense of litigation. And it happens long, long before a judge can throw out the lawsuit as frivolous.

of stats on how many suits never even see a judge, and how many dollars are exchanged without judgments. My gut (an ignorant organ when it comes to things litigious) says the majority of suits and dollars are untried.
